Halle Berry denies claims after ex Olivier Martinez accuses her of physically attacking 12-year-old son
Halle Berry has denied ex-husband Olivier Martinez’s claims accusing the actress of physically attacking their 12-year-old son, Maceo.
According to court documents obtained by Page Six, Martinez, 60, filed a temporary restraining order against Berry, 60, accusing her of jumping on their son, and choking him around his neck on September 26. In a statement via Berry’s lawyer, she said the filing was “deliberately misleading”.

Berry’s attorney Marina Beck addressed Martinez’s allegations in a scathing statement.
“To say this filing is entirely meritless and deliberately misleading would be an understatement,” it read.
“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo – misconduct for which Mr. Martinez has already been legally sanctioned.”
The statement continued: “In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behaviour.
“Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
In the court documents, Martinez alleged the altercation started after an argument over Maceo playing a virtual reality game.
He claims Berry’s fiance, singer Van Hunt, was present.
“The situation escalated and Petitioner jumped on our son and started physically fighting with him,” he claimed in the documents.

“She grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?!’”
According to the court files, Martinez claimed Maceo called him from his mother’s house asking his father to “come pick [him] up right now”.
Text messages included in the court documents show Maceo’s message to his dad which reads: “Are u here please come.”
Martinez claimed this is not the first time Berry had attacked their son.
“Throughout the last year and a half, Ms Berry had wrestled Maceo to the ground and forced him to ’tap out,” he alleged in the documents.

Martinez filed for a domestic violence restraining order against Berry on Thursday and asked the court to temporarily halt her visits with their son. The allegations have not been proven in court.
The filing was entered in Los Angeles Superior Court on October 1.
Berry and French actor Martinez first met in 2010 while co-starring in the action-thriller Dark Tide.
The couple got engaged in early 2012 and married in France in July 2013, welcoming their son, Maceo, a few months later in October.
Their high-profile romance frequently drew media attention, particularly in late 2012 following a heavily publicised physical altercation between Martinez and Berry’s ex-partner, Gabriel Aubry, over custody arrangements involving Berry’s daughter.
After five years together, Berry and Martinez filed for divorce in October 2015.
Ongoing disputes regarding child custody and financial arrangements dragged out for nearly eight years.
The divorce was formally resolved in August 2023, with both parties agreeing to joint physical and legal custody of their son alongside established child support terms.
