Actress Halle Berry has learned her fate after a drawn-out custody battle with ex-husband Olivier Martinez over their son Maceo, after Martinez accused the actress of abusing the 13-year-old.

A Los Angeles Superior Court Judge has tossed out Martinez’ request for a domestic violence restraining order against Berry, 60.

In doing so, Judge Shelley Kaufman freed the actress from temporary restrictions that had been in place since Martinez’ request was initially granted on October 1.

However, Kaufman also ruled that Berry and Martinez will continue to share legal custody of Maceo despite Berry’s requests for sole legal custody.

Berry’s attorney, Marina Beck, told Page Six the actress’ legal team is “extremely pleased” the Court dissolved the temporary restraining order against Berry.

Beck added that Berry’s focus remains on the well-being and best interests of her children as the bitter legal battle drags on.

Martinez, 60, accused Berry of physically abusing Maceo in his request for a restraining order.

He claimed the actress choked the 13-year-old during an incident on September 26, and alleged it wasn’t an isolated incident.

Berry has repeatedly denied the allegations against her.

“There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son, Maceo – misconduct for which Mr. Martinez has already been legally sanctioned,” Berry’s attorney previously told the outlet.

Berry’s daughter Nahla Aubry, 18, from a previous relationship with model Gabriel Aubry has also defended her mother.

In a declaration filed in Los Angeles Superior Court earlier this month, Nahla described her mother as loving and devoted, but strict when necessary.

“I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way,” she wrote.

“I have never seen my mom place her hands around Maceo’s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her.”

Nahla also testified in a closed courtroom during the custody hearing, as did Maceo, Berry, her fiancé Van Hunt, and Martinez.

Berry has accused Martinez of interfering with their son’s health and educational needs by dragging out their custody dispute.

The pair started dating in 2010, married in 2013 and welcomed their son that same year. They announced their separation in 2015 and filed for divorce in 2016.

The divorce wasn’t finalised until 2023, when Berry was ordered to pay Martinez $USD8000 ($11,400) in monthly child support after a lengthy court process, even though they shared joint physical custody.

They were back in court in 2024 to “resolve disputes and conflicts between them in an effort to successfully co-parent” Maceo, per documents obtained by Page Six.

Berry accused Martinez of trying to “delay” the proceedings and requested sole custody of their son later that year, and the legal battle continued to 2026.
