Scott Disick and Kim Kardashian sued for $59 million for promoting luxury prizes in alleged Instagram scam

Scott Disick and Kim Kardashian are being sued for $US40 million ($59 million) for promoting luxury prizes on Instagram that were allegedly part of a fake lottery scam. 

Contestants who entered the competition were allegedly promised prizes including first-class tickets to LA, a three-night stay in a Beverly Hills hotel and $US100,000 ($150,000) cash prize.

Disick, 39, and Kardashian, 41, teamed up with Aussie-based company Curated Businesses, who organised the competition in 2020, with the famous pair endorsing the contest while encouraging their millions of followers to enter.

However, in a class action lawsuit made up of entrants who participated in the contests but did not win, it is alleged the giveaway was a sham to sell their personal information to advertisers. 

In paperwork obtained by TMZ, the plaintiffs claim they have been "invaded by hundreds of advertisers, some of which are soliciting the Plaintiffs with potentially offensive and unwanted content".

The legal docs also included this passage: "Just a short 20 years ago, Oprah was giving away cars and cash. But today's entertainment tycoons seem to only care about becoming richer and living an even more opulent lifestyle, while duping their fans and followers."

As per the suit, Disick is allegedly the main organiser of the lotteries and his family members such as Kim, Khloé Kardashian, Kourtney Kardashian, Kris Jenner and Kylie Jenner helped promote it to their followers on Instagram, as well as fellow reality TV stars Real Housewives of Orange County's Gretchen Christine Rossi and Selling Sunset alum Christine Quinn.

Insiders also TMZ that there have been no "legitimate winners" or documentation to prove anyone actually won the competition.

However, sources close to Curated Businesses told the outlet every winner is legitimate and has been awarded their prizes, with the company in possession of appropriate paperwork as proof.

Likewise, on the Curated Businesses website, a list of campaign winners from 2019 to 2022 is shared and on the company's FAQs page, under the question "How is the winner selected?", they detail how the winner is selected.

"We engage the services of a third party facilitator to conduct a random draw of all eligible entrants," the business stated.

"Australian government approved and compliant. As required by Australian law, we also engage the services of fully qualified independent scrutineer to oversee the random draw."
