Jackie ‘O’ Henderson continues claim against ARN after Kyle’s $12 million settlement

Jackie ‘O’ Henderson will proceed with her Federal Court claim against her former employee ARN, a day after it was revealed her co-host Kyle Sandilands had settled with the network for $12.09 million.

Henderson, 51, did not appear in court in Sydney on Thursday and was not required to do so, but her legal representatives attended to discuss the next steps of her case after Sandilands’ update a day prior.

Henderson’s friend and manager Gemma O’Neill was there to observe the proceedings.

Henderson is suing for wrongful termination against ARN, claiming compensation of at least $82.25 million and alleging that her termination was against the Fair Work Act.

She is set to appear in court in August for a hearing, while the trial is due to start in October.

During the hearing on Thursday, the radio company was forced to cover the costs that Henderson had amassed for a cross-claim, which they have now dropped after the settlement with Sandilands.

Sandilands reached a settlement with ARN, with the news going public on Wednesday morning.

In a statement to the market, ARN said it had agreed to pay Sandilands a settlement sum of $12.09 million, with $3 million of the package payable in July 2026 and the balance payable monthly until June 2029.

As part of the settlement, ARN will provide Sandilands with “advertising services on ARN’s partner platforms”, worth $1.5 million over the next three years.

ARN’s chief executive officer Michael Stephenson said the deal ends legal action between the two parties.

“This agreement brings certainty for ARN and resolves the legal dispute,” Stephenson said.

“ARN remains focused on executing its strategy, including driving a leaner, more efficient operating model, strengthening its core radio network and continuing to invest in digital capabilities and long-term growth.”

During an appearance on Nine’s Today Show on Thursday morning, former radio presenter and radio executive James Cridland weighed in on the situation and thought that Henderson may opt for a settlement. 

“I mean Jackie will be looking at Kyle’s settlement and thinking, ‘Well, you know, there is an opportunity there that means that I don’t have to go through court’,” he explained. 

“I mean, nobody really wants to go through court.”

Cridland suggested that Henderson may be looking to see if she can also reach a settlement with her former employer, but it will be very different to Sandilands’.

“I’m not sure that Jackie was done particularly well by, so it will be fascinating to see what happens there,” he added.
