No assault charge for NSW Labor boss

Sydney detectives say they won't pursue an assault charge against top NSW Labor official Jamie Clements.

The general secretary of the party's NSW branch took leave earlier this month after Stefanie Jones contacted Labor leader Luke Foley's office with claims Mr Clements had assaulted her in NSW Parliament in June.

Ms Jones is a former candidate for the NSW seat of Cronulla and now a staffer for Campbelltown MP Greg Warren.

On Monday, after weeks of investigations, police confirmed they had decided not to lay charges.

"Based on the evidence, police will not be proceeding with the allegation of assault. However, investigators will proceed with an AVO application," NSW Police told AAP in a statement.

With the investigation wrapped up, Mr Clements said he was now heading back to work.

"Whilst an interim AVO remains in place, the conditions of that order have no impact on the ability to undertake my duties and I look forward to returning to work," he said in a statement.

Mr Clements has always maintained his innocence but did consent to a temporary apprehended violence order that banned him from approaching Ms Jones.

The interim order will remain in place at least until Wednesday, when the case is due back in a Sydney court.
