A 52-year-old man has been charged over the fatal capsize of a boat in the NSW Northern Rivers region earlier this year.

Emergency services had been called to Yamba Breakwater in the early hours of March 12, following reports a boat had flipped when crossing the Yamba coastal bar.

A multi-agency rescue operation was launched involving Marine Rescue NSW, Surf Life Saving NSW, the Westpac Rescue Helicopter, NSW Ambulance and NSW police.

They managed to pull the 52-year-old from the water and take him to Maclean District Hospital for an assessment and mandatory testing.

The team then retrieved two other people - a 52-year-old woman and a 58-year-old man - from the water a short time later.

They were treated by paramedics but died at the scene.

Following an investigation, the sole survivor was issued a Court Attendance Notice on Thursday for two counts of operate recreational vessel negligently causing death or grievous bodily harm.

He’s face Maclean Local Court in October.
