Spokesman for 'Mad Pooper' claims public defecation protected by First Amendment

The so-called "Mad Pooper" says she is justified in her actions after a family made a public plea for the woman to stop defecating on their lawn.

A man claiming to be a spokesman for the woman, who he calls Shirley, has spoken to local Colorado media in the US after a woman shared her battle to stop the "pooping" in her front yard.

Speaking to KRDO, the woman's spokesman said "Shirley" was sorry for her actions but claimed they were not her fault.

According to the spokesman, "Shirley" has a traumatic brain injury and after gender reassignment surgery cannot control herself.

He also asserted her right to defecate on people's lawns was protected under the First Amendment, comparing the action to breastfeeding in public.

Earlier this month, the story of "the Mad Pooper" went global after Cathy Budde told the BBC a woman had left waste in front her house about seven times in a matter of weeks.

Both Ms Budde and her children had caught the jogger in the act.

A criminal defense attorney has since debunked the First Amendment theory.

"Defecating in someone's yard is definitely not protected under the First Amendment and it is actually a crime," Jeremy Loew told KRDO.

He said the woman could also face indecent exposure charges.

KRDO said the spokesman refused to give them any proof he was speaking on behalf of the "Mad Pooper".
