A deal between Donald Trump and his own administration will spare him any investigation from the tax office is coming under scrutiny.

Trump had sued the Internal Revenue Service (IRS) for $A14 billion after a worker leaked his tax return to the media.

But under a settlement deal to avoid a trial, the president made an arrangement.

Trump’s own administration agreed that the tax office would be prohibited from auditing the president or his family.

The deal would mean past tax filings from the Trump family could not be scrutinised.

It has drawn the attention of Democrats in Congress.

“Are Republicans going to defend this free pass on corruption for Trump and all his shady businesses?” Senator Sheldon Whitehouse said.

“And why do the Trumps think they need this kind of amnesty anyhow?”

The arrangement was in the same settlement as the controversial compensation fund for Trump supporters prosecuted for their crimes.

The administration backed out of their plans for the multi-billion fund yesterday, but the tax deal remains.

“Nothing has changed with that,” Trump’s acting attorney-general and former personal lawyer Todd Blanche told a subcommittee hearing today.

Blanche said the deal for no more audits was standard in settlements with the IRS - even though this case had nothing to do with an investigation of the president’s taxes

“It’s not a forward-looking document,” he said.

“It’s nothing that gives any sort of immunity in the future to the president or his family or his organisations.”

But Democratic Senator Elizabeth Warren slammed the arrangement.

Elizabeth Warren has described Donald Trump's actions as "theft".

“Dropping one of those audits could save Trump $100 million ($A139 million),” she said.

Warren said she had written legislation to “stop this corruption”.

Democratic Congressman Jim McGovern said it was the kind of “large-scale corruption you’d expect in Russia or North Korea”.

“Trump’s own government gave him, his kids, and his companies lifetime immunity from IRS audits and tax prosecution,” McGovern said.

“It’s effectively a blanket pardon for cheating on their taxes.

“They line their own pockets with taxpayer money and get out of jail free.”

Trump and his two elder sons sued after his tax information was leaked to the media in 2018 and 2020.

A former IRS contractor has already been jailed over the leak, which exposed Trump’s claims of incredible business success to be in part, false.

Some years Trump paid nothing in taxes because of the vast amount of money he had lost in bad investments.

The year he ran for president he paid barely $1000 in taxes.

The subject of Trump’s tax returns has been a long running source of scrutiny and criticism.

Presidential candidates have for decades released their tax returns to the public.

In 2016, Trump broke that tradition on the justification that he was being audited.

There is no legal reason why a person being audited cannot do so.

Ten years later, he has still not voluntarily released any tax returns.
