British model Chloe Ayling will not have to face her alleged kidnappers

British model Chloe Ayling will not have to fly to Italy to give evidence in the trial of her alleged abductor Lukasz Herba, a Milan court has ruled.

On Wednesday, the court dismissed Kukasz' lawyer Katia Kolakowska's claims that Ms Ayling had fabricated her own kidnap plot, while rejecting her application to compel Ms Ayling to fly to Italy to give evidence.

Ms Ayling's lawyers argued she did not want to return to Italy and see the face of her kidnappers again.

The decision comes on the first day of 30-year-old Lukasz' trial. The case was adjourned until February 7.

Ayling claimed she was drugged and kidnapped by a group calling itself Black Death, after they lured her with a fake modelling shoot in Milan in July. Her captors allegedly demanded €300,000 ransom.

She was allegedly held hostage for six days before Lukasz drove her to Milan and handed her over to the British consulate, where he was immediately arrested.

Lukasz has denied the charges, claiming the "kidnapping" was a stunt to help Ms Ayling to get famous and advance her modelling career.

He is charged with conspiring with his older brother Michal, 36, who remains in custody in Birmingham but is facing extradition to Italy to face trial.

Michal has remained in custody since he was arrested in August. His lawyer argued extradition could breach his human rights as he has a heavily pregnant girlfriend living in the UK.

During his extradition trial in September, Michel's lawyer told Westminster Magistrates' Court the entire case could be a “publicity stunt”.

“There is a real risk that the entire case is a sham,” Michal’s lawyer George Hepburne Scott said.

He pointed to the fact Ayling has been spotted shopping for shoes with her captor, calling it a “wholly anomalous feature of a hostage situation”.

He added that she went to breakfast with her alleged kidnapper before her release.

"This case has a unique set of anomalies which might lead to the conclusion that the Italian authorities have been duped and that their process has been abused," Mr Scott told the district judge.

He also said there was a lack of “particularity” to Ayling’s allegations.

Doubts have been raised over Ms Ayling's story after she was caught lying to Italian police.

According to The Sun, the 20-year-old told authorities she was given the tracksuit and shoes she was wearing by her kidnappers before leaving the house.

However, a shop assistant confirmed to police Chloe was with Michal and Lukasz when they bought the outfit.

The model is alleged to have broken down in tears when they caught her out in the lie, telling police she didn't have an explanation. 

A transcript from Ayling's three interviews with police over 13 hours, reveals her reaction to being told about the shop assistant's piece of information, which contradicts her story.

"It is true. I went with him to buy the shoes," she said.

"So why did you lie to us?" Police ask, to which she replied while allegedly breaking down in tears: “I don’t have a reasonable explanation."

"Don’t you think it seems strange that you went to buy shoes with the person who kidnapped you?" Another police officer asked.

"He was the person who could save me and who could help me regain my freedom," she replied, adding: "That’s the reason I didn’t fight and I didn’t ask for help from the woman in the shop."

Ayling recently revealed she will expose “every little detail” about her kidnapping ordeal in a tell-all book.
