Kevin Hart was not wearing a seatbelt at the time of his car accident

Kevin Hart and his two friends that were involved in a car crash last month weren't wearing seatbelts, according to a crash report.

Hart suffered "major back injuries" in the accident after his 1970 Plymouth Barracuda veered off a highway in Malibu, Los Angeles.

The accident happened on September 1, and Hart was taken to hospital with "major back injuries" according to police. He was in the car with Jared Black and Rebecca Broxterman when the collision occurred. Black was reportedly behind the wheel.

Hart, 40, was in hospital for 10 days before being released to get physical therapy at a rehabilitation facility.

New details from the crash report obtained by TMZ state that none of the three people in the car were wearing seatbelts.

The report states: "There were fold and crease marks on the belt surfaces consistent with being folded and tucked into the seats and no indicators of occupant loading were present."

Police indicate that if seatbelts were worn, "they were being worn improperly due to excessive slack in the belts."

The outlet also reported that the car didn't have any mechanical problems and the accident occurred due to "driver error".

It was also reported that Black — who was reportedly driving the car when it crashed — lost control after a sudden acceleration.

Hart has now released a statement to E! News, where he breaks his silence on the two other people in the car. "I have nothing but love for Jared and wish him and Rebecca a speedy recovery," Hart said.

The incident occurred when Hart, Black and Broxterman were driving to Malibu, California. Hart was in the front passenger seat when the car swung off Mullholland Highway, crashed through a fence and wound up in an embankment.

The Ride Along star had to get his spine fused back together after breaking it in three spots.

Hart's wife, Eniko Hart, gave an encouraging update on him when he was released from hospital.

"He's doing well, thank you," she told paparazzi at the time. "We're just taking it one day at a time... He'll be back on track in no time."

The accident is still under investigation.
