Kesha’s producer asks judge to toss out her rape claims

The music producer accused of sexually assaulting pop star Kesha has called for a judge to dismiss the claims.

According to the New York Post, Luke’s attorneys are arguing that the alleged rape could not have occurred within the last two years. This means the “statute of limitations” (the period during which a crime can be prosecuted in the U.S.) has expired.

Whatever happened to simply declaring your innocence?

Kesha, 27, filed a civil lawsuit against Dr. Luke (nee Lukasz Gottwald), 41, last month, claiming sexual, physical and verbal abuse. However, the legal documents fail to mention when the alleged rape happened.

“The facts presented in our lawsuit paint a picture of a man who is controlling and willing to commit horrible acts of abuse in an attempt to intimidate an impressionable, talented, young female artist into submission for his personal gain,” Kesha’s attorney, Mark Geragos, said at the time.

Complicating the case, Kesha denied any sexual misconduct by Luke in a 2011 deposition. Why didn’t she speak up at the time? Geragos says Luke threatened her if she ever discussed it.

Kesha has also blamed Luke’s critical comments about her weight for her developing an eating disorder, which she was treated for earlier this year.

“Dr. Luke is hiding behind a legally flawed motion which we expect won’t work,” Geragos said in an email to the Post.

And the plot continues to thicken.
