Loophole exposed for drivers testing positive to drugs

The WA Government is moving to scrap a legal loophole that allows drug-affected drivers to stay behind the wheel after testing positive.

Unlike most other states, there's no immediate roadside ban for drug drivers, regardless of how high their reading is.

Meanwhile, drink-drivers who blow over the limit will have to find another way home.

"It's almost incomprehensible to think that that hadn't already been done here in Western Australia," Police Minister Michelle Roberts said.

The reforms will also feature a new penalty for drivers impaired by a combination of drugs and alcohol.

Currently, those found to have one in their system won't be tested for the other.

Fines for low-range drink driving will jump from $500 to $1250 for first-time offenders, but it is likely to be months until the beefed-up laws come into effect.
