Upgraded charge for fatal nightclub shove

A security officer who allegedly fatally shoved a drunk man who tried to hug him outside a Perth nightclub has had his charge upgraded.

Patrick Sunill Lilii was initially charged with grievous bodily harm over the incident outside a Murray Street nightclub on April 20.

The victim, 32-year-old Zak Harvey, later died from head injuries.

Lilii, who was 26 at the time of the offence, has had his original charge discontinued and instead faces a charge of unlawfully assaulting another who died as a direct or indirect result of the assault.

In Perth Magistrates Court on Thursday, his lawyer said the matter would proceed to trial, having previously flagged his client would fight the allegation.

Lilii, who has had to surrender his New Zealand passport, must regularly report to his local police station as a condition of his bail.

The court also heard he was no longer a fly-in fly-out worker on Barrow Island in Western Australia's north.

Earlier this month, the State Administrative Tribunal upheld a decision by WA Police Commissioner Karl O'Callaghan to suspend Lilii's security agent's licence. The case will return to court on September 25.
