Eurydice Dixon killer's loses appeal bid

Eurydice Dixon's sadistic killer has failed to overturn his life sentence for the "unspeakably loathsome and cruel" rape and murder of the aspiring Melbourne comedian.

Rapist and murderer Jaymes Todd claimed the sentence was "manifestly excessive" because it was too long and disproportionate to the crime.

But Court of Appeal Justices Anne Ferguson, David Beach and Phillip Priest rejected this.

"A young woman should be able to walk home alone after a night out without any fear of being harmed, let alone subjected to a vile sexual attack and killed," they wrote in their judgment handed down on Thursday.

The crime against Ms Dixon was "unspeakably loathsome and cruel", the trio said.

"She should not have to be looking over her shoulder to see if anyone is following her. Her heart should not have to skip a beat when she hears approaching steps from behind.

"Tragically this case shows that women still cannot have confidence that they can walk in public places at night without potentially attracting the attention of predators."

Ms Dixon was nearly home from a night out at a comedy club when she was raped and murdered in June 2018.

Todd, then 19, stalked his 22-year-old victim for more than an hour before the attack at Carlton North's Princes Park.

After the murder, the then-19-year-old bought a pie and coffee and returned to the Carlton North crime scene.

His lawyer Daniel Gurvich QC accepted Todd's "heinous and horrific" crimes warranted a severe punishment, but not as long as the one he received.

He argued mitigating factors including his age, lack of criminal history and mild autism should have spared him a life sentence.

Mr Gurvich also said the original sentencing judge should taken into account his guilty plea, the fact he was in protective custody and his dysfunctional home life.

But the appeal judges dismissed this and said Justice Stephen Kaye carefully took these factors into account.

Todd also has an "untreatable" sexual sadism disorder with an underlying paraphilic interest which was the main cause of his horrific crime.

"The sentence of life imprisonment was not disproportionate," the appeal justices wrote.

Todd, who will turn 21 next month, was jailed for life last year and will not be eligible for parole until 2054.
