The Tasmanian government has again rejected claims that its proposed takeover of TasWater is unlawful and has sought legal advice to confirm its stance.

The water and sewerage provider, owned and operated by the state's 29 councils, has struggled to supply services to some townships and the apple isle's Liberal administration announced plans to take over the business in a move that's been labelled unconstitutional by some opponents.

"We have sought additional legal advice from the solicitor-general ... (and) we are now more confident than ever that the TasWater takeover is lawful," Treasurer Peter Gutwein said on Tuesday, adding that the move is in the best interests of the community.
