Surfers Paradise hotel guard jailed after breaking man's jaw

A security guard who broke a man's jaw with a punch outside a Gold Coast hotel will spend the next year behind bars.

Dennis Hecta Tipene Faulkner, 42, was today sentenced in the Southport District Court to two-and-a-half years' jail for causing grievous bodily harm to Dominic Beinke.

The assault happened outside the Grand Chancellor Hotel in Surfers Paradise early on February 9, 2014.

Faulkner will serve 12 months of the sentence before the remainder is suspended for a period of three years.

The former Australian Army soldier was found guilty of punching Mr Beinke, who had travelled to the Gold Coast from Sydney to celebrate a friend's engagement.

Mr Beinke had been attempting to take his brother to the hotel where he was staying when the pair were refused entry by Faulkner and another guard.

After Faulkner took Mr Brinke outside to the hotel driveway, CCTV footage showed him punching Mr Beinke's face.

Mr Beinke fell unconscious for a short time, and his jaw was broken in two places by the blow.

He told the court he thought he had lost his teeth after waking up "in a puddle of blood".

Judge David Kent said he felt security had taken the right action to eject the pair from the hotel after they had been refused entry.

But he criticised Faulkner for continuing to interact with Mr Beinke outside before throwing the punch.

"It's amazing what these people perceive their powers to be," Judge Kent told the court.

"Once they were excluded from the premises ... why not lock the doors and wait for the police to arrive?"

Faulkner's barrister Chris Rosser said his client had post-traumatic stress disorder from his time in the armed forces and there had been a "level of provocation" from the brothers, describing their behaviour as "appalling".

Judge Kent said while he understood it could be difficult for hotel staff to deal with intoxicated people, Faulkner had been lucky Mr Beinke's injuries weren't more serious.

"It was a severe blow that could have been much worse," he said.
