Malcolm Turnbull says the referral of two senators to the High Court over their eligibility to be elected doesn't amount to "chaos" in the Senate.

Labor says the referrals of former senator Bob Day and One Nation's Rod Culleton to the court is a sign the government is dysfunctional.

"This is orderly business, this is what happens in a constitutional democracy, governed by the rule of law," Mr Turnbull told reporters in Sydney on Thursday.
