Qld bikie case magistrate to stay on

Lawyers for an alleged bikie on rioting charges over an infamous Gold Coast brawl have failed in their bid to have the magistrate stood aside over perceived bias.

The ugly incident in late 2013 saw about 20 Bandidos members and associates enter a busy Broadbeach restaurant to bring a rival gang member outside.

Police officers' evidence described to the Southport Magistrates Court the heated scenes as they tried to get the group under control.

Peter Mauric, 45, was the only one of 10 alleged Bandidos to plead not guilty to charges.

Mauric's barrister, Geoffrey Foster, on Thursday launched an application to have Magistrate Michael Quinn stood aside in the case.

"The defendant requested the magistrate to stand down from the case on the basis that he displayed apprehended or perceived bias," a member of Mauric's legal team told AAP.

The application was partially based upon a conversation between a prosecution witness and a member of court staff, she said.

The case will resume on Monday morning.
