Qld pedophile avoids jail time again

A member of a pedophile trio jailed in the 1990s for luring schoolboys to a house and molesting them has avoided time behind bars for breaching conditions of his suspended sentence.

Neville Douglas Briggs angrily swatted away a news photographer on Wednesday as he left the Brisbane District Court, where the operational period of his two-year suspended sentence was extended by six months.

The original term was imposed in February 2012 after Briggs, as one of a trio of pedophiles, was convicted for his role in the group that would lure truant schoolboys to a house and molest them in the 1990s.

Briggs, who had previously served a jail term in the 1990s for similar offences, had pleaded guilty to sexually abusing a then-teenager over a period of about seven months.

But despite also committing an earlier breach, Judge Paul Smith on Wednesday chose not to grant the Crown's request to activate part or whole of the suspended term.

It came after the court heard Briggs had failed to report to police on time in February and was also found to have a Facebook and email account on his mobile phone without approval.

Crown prosecutor Steven Dickson said the original offending was "extremely serious" and actual time in custody was justified given a "no tolerance" approach by police to breaches.

But Briggs' legal team argued the 63-year-old was battling a number of ailments and said he was seeing a psychologist for assistance with anxiety and depression.

His two-year suspended term will now be in place until August 2017.
