New hearing for officer over gun incident

An outback Queensland police officer convicted of pulling a gun on a driver and threatening to shoot will return to Brisbane Magistrates Court for a fresh hearing after winning an appeal.

Brisbane District Court judge Julie Ryrie has found in favour of Senior Constable Stephen Flanagan and ordered his conviction be set aside on appeal.

The matter, which relates to a controversial incident on a highway outside Longreach in May 2015, will now be sent back for a hearing before a different magistrate than the one who made the initial ruling.

Flanagan is currently suspended without pay.
