Gold Coast man on trial for Aust Day rape

A Queensland man raped a woman shortly after they met at an Australia Day party on the Gold Coast last year, a court has been told.

Harley Gene Lewis is standing trial on charges of rape and sexual assault with the circumstance of aggravation.

Lewis pleaded not guilty to both charges at the start of his trial in the Southport District Court on Monday.

The court was told Lewis and the woman had met for the first time at a party on Australia Day last year. The party was hosted by the woman and others at a unit complex.

Crown prosecutor Sarah Lio-Willie said the pair had spoken briefly at the party before Lewis had lifted the woman up and carried her to a bedroom about 4am the next morning.

It's alleged he then removed her shorts and bikini bottom and sexually assaulted her.

Ms Lio-Willie said Lewis had grabbed the woman's neck during the assault.

It's also alleged the woman's hands were tied up with the drawstring from Lewis' boardshorts.

"(The woman) faked an orgasm and the defendant stopped," Ms Lio-Willie said.

"None of that was done with her consent.

"Just because (she) did not say no, does not mean yes, and certainly (it) does not mean yes to such rough sexual activity leaving her with these injuries from a man she had just met."

Lewis' barrister Anthony Kimmins said his client would not be contesting that a sexual encounter occurred, but that it had been consensual or Lewis had "honestly and reasonably" believed she had consented.

The trial, which is expected to last four days, continues.
