CFMEU, firm 'excluded' company from site

The CFMEU and a landscaping firm will go to court after a waterproofing company was allegedly kicked off a Brisbane construction site because it did not have a union enterprise agreement.

A claim filed in the Federal Circuit Court alleges Dig-It Landscapes breached the Fair Work Act by terminating a contract with the waterproofing company after the CFMEU said it was not allowed to work on site.

Fair Work's Nigel Hadgkiss said subcontractors and their workers ought to be able to enter into any enterprise agreement without facing the threat of being excluded from worksites.

The case will be mentioned in court on April 4.
