Visa issues delay Miller accused bail bid

A young man charged over the one-punch death of Brisbane teenager Cole Miller has had his bail bid postponed due to visa issues.

Daniel Jermaine Lee Maxwell, 21, is one of two men facing a charge of unlawful striking causing the death of Mr Miller, an elite water polo player, in January.

A Supreme Court application was scheduled for Thursday but was adjourned to a date to be fixed after it was heard the New Zealand national may be taken into immigration custody if bailed.

Outside court, his lawyer Michael Bosscher said neither the defence nor the crown had any notice until Thursday morning of the visa complications.

"We received information from the Australian Border Force that even if he were granted bail today that they would be likely to take him into immigration custody," he said.

"It was something sprung on both sides."

He said he hadn't encountered this type of problem with a New Zealander before and, if granted bail, Maxwell could be taken into any number of detention centres in Australia.

This would make it much harder for his legal team to access their client, Mr Bosscher said.

"They can put him anywhere in Australia, even Nauru if they chose," he said.

"It's certainly put a rather large spanner in the works."

In documents filed ahead of the now delayed hearing, the young man insists he rarely drinks alcohol and is not a naturally violent person.

"I have difficulty explaining my actions on that particular evening," it reads.

The file says Maxwell had been drinking that night after being taken out for his birthday by a group, including his co-accused, Armstrong Renata.

Police have alleged Maxwell turned to the group moments before the attack in Fortitude Valley and said: "Do you want to see something funny?"

He then challenged the nearby Mr Miller, 18, to a fight and threw the first punches, they claim.

The young sportsman died in hospital from massive head trauma on January 4.
