The man accused of stabbing his ex-girlfriend in the neck outside a Sydney gym yesterday evening had an AVO out against him at the time of the attack, A Current Affair has learned.

Anthony Monteleone, 45, was tonight charged with wounding with intent to murder (DV) and contravening an apprehensive violence order (AVO) after allegedly stabbing his ex-girlfriend in the face and neck in the carpark of Crunch Fitness in Alexandria.

Police allege he may have lay in wait for up to two hours before he struck in a frenzied attack and then fled the scene.

He handed himself in to police this morning.

His 39-year-old alleged victim was taken to the Royal Prince Alfred Hospital, where she underwent a number of operations for injuries to her face and neck.

A Current Affair understands Monteleone had an eight-week relationship with his victim, and later had an AVO taken out against him after he continued contacting her via social media after the relationship ended last month.

It has emerged that last month he breached that AVO and was arrested by police on Sydney's Northern beaches.

He was refused bail and went to court the next day, where he pleaded guilty to the charge, but was released back into the community.

The case raises real questions about how offenders are dealt with by the courts.
