Mother wants name of cop who killed daughter

The mother of a student who was shot by police in a bungled rescue mission is demanding a judge release the name of the officer who accidentally killed her daughter.

Andrea Rebello, 21, was killed in May last year after police officers responded to a home invasion at the Nassau County home she was visiting.

When police arrived they found Dalton Smith, 30, using Andrea as a human shield and pointing a gun at her head.

The officer fired eight shots at Smith, hitting him seven times – with the final shot hitting Andrea in the head. She was killed instantly.

Now Andrea's mother, Nella, has filed papers in the State Supreme Court ordering authorities to release the name of the officer who pulled the fatal trigger.

"As of today, no one from the Police Department has ever told me who shot the bullet that killed my daughter, who was in charge when she was shot or how it came to be that they did not wait for a hostage negotiator to come and try to save her," Nella Rebello said in a court affidavit filed Wednesday.

Earlier reports from the NY Post claimed that Nikolas Budimluc was the officer responsible for Andrea's death – but police from Nassau County are refusing to confirm or deny the reports.
