Exclusive: Woman sues officer who fatally shot Justine Ruszczyk for assault and battery

9NEWS has obtained exclusive details about a woman who is suing Minneapolis policeman Mohamed Noor over an encounter just weeks before he killed Australian Justine Ruszczyk.

Teresa Graham, a retired social worker, lives less than two kilometres away from where Mr Noor fatally shot Ms Ruczskyk, 40, last Saturday night.

On May 25 this year, it was Mr Noor who responded to Ms Graham’s 911 call.

She reported there was a strange man smoking marijuana at the back of her house on a retaining wall.

Court documents obtained by 9NEWS revealed Ms Graham is claiming Mr Noor, along with two other officers, forced their way into her home.

She claimed Mr Noor snatched her mobile phone, before grabbing her wrist and arm so she couldn’t move.

It is alleged the officers told Ms Graham she was in a “mental health crisis" so they were taking her to hospital.

She filed a lawsuit against Mr Noor for imprisonment, assault, battery and negligence on July 14.

Neighbours who have known Ms Graham for more than 30 years said she “probably exaggerated” the incident.

“You need to take it with a grain of salt and not tar and feather him before we figure out what really happened,” Doris Phillips said.

Fellow local Mitch Wiklund added that there were a “a lot of times” Ms Graham would “call 911 then lock the door and turn the lights off”.

The lawsuit comes as it was revealed that Ms Ruczskyk called her husband, Don Damond, before calling police on the night she was shot.

She told Mr Damond she could hear a woman screaming, prompting her fiancé to tell her to dial 911.
