Biden's legal team 'standing by' ready to fight Trump in US Supreme Court

Democrat Joe Biden's campaign says it will fight any efforts by President Donald Trump's campaign to go to the US Supreme Court to prevent ballots from being tabulated.

In a statement sent before 4am Wednesday (8pm AEDT), Biden campaign manager Jen O'Malley Dillon said Trump's words were “outrageous, unprecedented and incorrect.”

Trump had said he will “be going to the US Supreme Court” and that he wants “all voting to stop”.

No major news outlets have declared a winner in the presidential race.

There are still hundreds of thousands of votes left to be counted, and the outcome hinges on a handful of uncalled battleground states.

Earlier in the evening, Mr Biden addressed a drive-in rally saying he believes he is on track to win the election.

"We believe we're on track to win this election. And it ain't over until every vote is counted," he said.

Making a surprise announcement after a long night of counting, Biden said he was optimistic of victory and called for patience.

"Your patience is commendable. We knew this was going to go on, but who knew we were going to go into maybe tomorrow morning, maybe even longer," Biden said.

"I am here to tell you tonight that we believe we are on track to win this election."
