Will Meghan and Harry's daughter Lilibet be a British or American citizen?

Following the birth of Prince Harry and Meghan Markle's daughter Lilibet Mountbatten-Windsor, there are questions over whether she will hold British or American citizenship.

The Duke and Duchess of Sussex's first child Archie Harrison, two, retains dual nationality of the United Kingdom and the United States, and it seems his new sister will too.

Archie was born in London several months prior to his parents' resignation as working royals, while Lilibet Diana was delivered in Santa Barbara on June 4.

Because Meghan retains her US citizenship, both of her children have automatically qualified for the same status regardless of where they were born.

"According to US law, in most situations, any child born in the US or one of its territories automatically becomes an American citizen," CS Global Partners, a legal consultancy firm specialising in citizenship, explained earlier this year.

The company cites the 14th Amendment right in the US Constitution, which states "all persons born or naturalised in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

The right does not include children born to diplomats or government officials from foreign countries. "Due to the fact that Prince Harry is no longer a working royal, the child, if born in the US, would obtain US citizenship at birth," CS Global Partners noted.

Lili will also have British citizenship, thanks to her dad. As Prince Harry remains a citizen, he may pass down the status one generation, as stipulated by British law.

"The new baby will automatically become a British citizen given that the baby will be born after 1 July 2006 and Prince Harry is a British citizen by birth," CS Global partners explained.

When Harry and Meghan married in 2018, it was announced the duchess intended to become a British citizen. However, the process can take several years to complete and the couple have since left the country.

The Sussexes announced they were expecting their second child in February.

They shared a black-and-white portrait featuring both of them barefoot in a garden, cradling the growing bump, and declared Archie was "going to be a big brother".

The news was met with jubilation from fans, and was particularly poignant as Meghan had revealed only months earlier, in a heartbreaking essay for the New York Times, that she had suffered a miscarriage in the summer of 2020.

"I knew, as I clutched my firstborn child, that I was losing my second," she wrote.

The couple revealed their second child was a girl during their interview with Oprah Winfrey, which aired in March.

Harry and Meghan announced the news of Lili's arrival via their Archewell Foundation website, explaining she's named after the Queen and Princess Diana.
