Sofia Vergara's ex-fiancé Nick Loeb loses appeal in embryo battle

Sofia Vergara's ex Nick Loeb has lost a legal battle over the custody rights to her frozen embryos.

On January 27, the Louisiana court ruled in Vergara's favour and denied Loeb's appeal, in documents obtained by People.

The court also reversed an order that sealed discovery in the case, and documents related to the case are now available to the public.

Vergara, 48, and Loeb, 45, called off their engagement in May 2014. Since the split, Loeb sought to gain custody of the 2013 embryos.

Vergara has an adult son named Manolo and went on to marry married Joe Manganiello in 2015.

The appeals court referred to the case as a "mockery of the Louisiana legal system."

The court ruled Loeb "is not domiciled in, does not maintain a residence in, and does not have the intent to be domiciled or a resident of any parish in the State of Louisiana" and accused Loeb's team of "forum shopping".

"Furthermore, based on all of the facts ascertained through the deposition testimony, exhibits, affidavits and allegations contained in Appellant's petition and first amended complaint, it is clear that Mr. Loeb blatantly engaged in forum shopping when he selected, in concert with a member of the bar ... Plaquemines Parish to file the instant lawsuit, with full knowledge that it was the improper venue," the court documents read. "Their behaviour brings disrepute to and makes a mockery of the Louisiana legal system and the bar and is abhorrent."
