WA man complained of injuries from police

Video from a police station showing an associate professor of law complaining he had been injured during his arrest has been played to a Perth court.

Robert Cunningham and his wife Catherine Atoms are suing the state of Western Australia and three officers - Peter Clark, Simon Traynor and Glenn Caldwell - for malicious prosecution, false imprisonment, assault and battery.

The couple was allegedly tasered and taken to Fremantle police station after trying to help a stranger who had fallen in some bushes near the Esplanade Hotel in November 2008.

In the footage played to the WA District Court on Tuesday, Dr Cunningham told police he wanted to receive medical treatment for his "muscular injuries" after his body was twisted during the arrest.

He also said he had a weapon "applied" to him and he was held to the ground.

But the officer replied he was not too concerned.

"You can go to the hospital if you like when you leave here," he said.

"To me, you're fit and well."

Ms Atoms also complained, telling officers she had done nothing wrong and should have been allowed to leave instead of being arrested.

"You actually grabbed me and started physically assaulting me," she said.

The officer said Ms Atoms had been issued a move on notice and was obstructing police.

Dr Cunningham and Ms Atoms were charged with obstructing a public officer but the case was dismissed in the Perth Magistrates Court in 2010, with the magistrate saying evidence from the arresting officer lacked credibility.

The trial continues.
