Angry neighbour loses fight against hotel noise

A disgruntled neighbour has lost his fight against a Perth Hotel over noise levels.

The mining entrepreneur wanted the Raffles' operations restricted but his claim was dismissed in the Supreme Court this morning.

Derek Ammon lives in a $2.7 million apartment just above the Raffle Hotel's beer garden.

The mining entrepreneur taking the owners to court for what he claimed was a breach of noise restrictions.

He claimed ever since a refurbishment four years ago, he'd needed industrial strength headphones to read and sleep and the excessive noise was ruining his ability to enjoy his apartment.

But today a judge ruled in the pub's favour, dismissing Mr Ammon's case saying he bought next to a hotel, to now seek to shut down its operations is not appropriate.

This brings to an end a long-running dispute between the neighbour and the company behind the Raffles.

Throughout the hearing the court was shown security vision of Mr Ammon throwing tomatoes at patrons from his balcony.

He claimed he'd reached "breaking point".

But other residents say the Raffles if part of the appeal of the apartments and today's decision comes as a relief.

Mr Ammon didn't respond requests for an interview today.
