Vic Nats MP to avoid court before election

A legal cloud over a Victorian Nationals MP won't be cleared ahead of this month's state election.

While Tim McCurdy will fight to hold his safe regional Ovens Valley seat on November 24, he'll have to wait until next year to fight allegations he wrongly collected $269,000 in real estate commissions almost a decade ago.

McCurdy maintains his innocence on fraud-related charges.

After a brief mention in the County Court on Friday, the case was adjourned to January 24 next year at Shepparton for a further mention.

Victorian Nationals leader Peter Walsh has said it "wasn't ideal" to have the matter hanging over McCurdy before the state election, but he's confident the MP can retain the trust of voters.

"Tim is looking forward to actually having that opportunity in court to clear his name," Mr Walsh told AAP.

"He is absolutely adamant he has done nothing wrong. On all the evidence I have seen, I agree with him.

"But there is a process to be gone through for him to have his day in court to prove that."

McCurdy holds his safe regional seat with a 16.6 per cent margin.
