Trans woman foils incest with iPad: court

A transgender woman whose stepfather began forcing sex on her after she had gender reassignment surgery secretly filmed the attacks and gave the footage to police.

The man first attempted to kiss his stepdaughter when she was a young adult about a year after her operation, telling her: "I just can't help myself, you've just become such a beautiful woman", a court has heard.

The woman pushed her stepfather away, but a few days later, while her mother was at church, he forced himself on her, saying: "I know you've been wanting this since your operation".

He then told her: "If you dare say anything I'm going to take your mum for all she's worth", the court heard.

The man, who cannot be identified, has pleaded guilty to four counts of incest relating to 13 years of repeated incidents.

Prosecutor John Livitsanos on Monday told the Victorian County Court the man reiterated his plans to financially ruin the woman's mother if she told anyone what he was doing, and she felt unable to stop it.

"He would tell the complainant she was his second wife and she should be happy because not many men would want to be with a woman like her - referring to the fact that she was transgender," Mr Livitsanos said.

"She did not know how to make him stop."

One night he took her to a hotel, saying it was their "honeymoon", and he wanted to have vaginal sex with her for the first time.

The victim, who had not been sexually active as a woman, told him she wasn't ready.

"The complainant was scared of being damaged," Mr Livitsanos said.

The woman's stepfather forced himself on her, despite her cries of pain, the court heard.

The forced sexual activity continued for 13 years until the woman got the idea to film the attacks.

In 2015, while he was attempting sexual activity with her he saw the iPad, and the two of them struggled.

He left the house and the woman gave the footage to police.

In a victim impact statement read to the court, the woman said she was struggling to find her identity when her stepfather came into her life.

"He is a remorseless, amoral and dangerous individual," she said.

Defence barrister Bradley Newton said the man made early admissions of guilt, sparing the woman a trial, and there was no physical violence other than the sex acts.

Judge Frank Gucciardo said this was a "facile" point.

"The sexual activity is violence against her person," he said.

Mr Newton clarified that he meant the case was unusual because no weapons were used.

The plea hearing continues.
