International travellers arriving in Victoria will be able to have their hotel quarantine obligation reviewed by lawyers, following the state's judicial inquiry into the rebooted system.

The Department of Health confirmed overseas arrivals would be permitted to appeal their detention from next Tuesday, with an independent panel of lawyers deciding whether hotel quarantine is necessary.

The whole review process is supposed to take no longer than 24 hours and forms part of recommendations made by the state's Hotel Quarantine Inquiry.

According to the Public Health and Wellbeing Amendment (State of Emergency Extension) Act 2021, international arrivals have the right to appeal their stay in hotel quarantine.

"A person who is subject to detention under section 200(1)(a) may make an application to the Secretary for a review by a Detention," it reads.

"The Detention Review Officer must use their best endeavours to decide the application, and advise the applicant in writing of the decision and the reasons for it, within 24 hours after the application was received by the Secretary."

All applications must be referred to an officer immediately after they are made for review.

Detention review officers then must make a decision within 24 hours of receiving the application or refer it to the Chief Health Officer to make a final decision.

People detained in hotel quarantine can make multiple applications if their circumstances change.

Exemptions to leave quarantine can still be granted for various reasons, including on compassionate or medical grounds, such as people wishing to attend a funeral or visit a dying relative.

The department said if an exemption is denied, the person could then choose to apply for their case to be reviewed by a detention officer.

The state's embattled hotel quarantine program relaunched for the third time on April 8 last week.

Quarantine was paused in February after COVID-19 once again seeped out of the hotel system, sparking the Holiday Inn cluster and prompting a snap five-day lockdown.
