A young boy who was forced to shut down a small pop-up shop he set up alongside a local footpath said he will take his case to the mayor after residents complained about it.

Jesse Lane created "Jesse's Shop" in Sydney's eastern suburbs and started selling snacks, sunscreen and dog treats at the local park, with some of the profits going to the Australian Skin Cancer Foundation.

But when nearby neighbours went to council, he was told there were insurance issues and he had to stop.

"I'm quite devastated really, I really wanted to continue," Jesse told Today Extra.

"They were thinking that if there is one store in the park today, there will be 20 tomorrow - but really that is not going to happen."

But a petition Jesse started to keep the shop open has already gathered more than 8000 signatures and he plans to present it to the local mayor in the next few days to have council's decision overturned.

He has also cleared up the insurance issue and while bottled water and coconut water are the most popular items he sells, he is already planning to expand his range.

"I'll probably add a few more things," he said.

"A lot of people have said I should add chips. I am not sure if I can but that would be the next thing I would look at."
