Russell St bomber Craig Minogue denied parole by High Court

Russell Street bomber Craig Minogue will likely die behind bars after losing an appeal to keep him in prison indefinitely.

This morning the High Court of Australia rejected his appeal against the state of Victoria to be released from jail, 33 years after he murdered a policewoman with a car bomb.

The court made the decision unanimously.

The 57-year-old made a parole bid in 2016, prompting the Victorian government to bring in tough laws, ensuring anyone who murdered a police officer had no chance of parole.

In 2018, Minogue successfully challenged the law at the High Court, which concluded the laws did not apply to Minogue because the "offence committed was indiscriminate and no particular person or class of persons was targeted".

Two months later, the government introduced another bill, ensuring Minogue would only be released from prison if he was "in imminent danger of dying or is seriously incapacitated and, as a result, he no longer has the physical ability to do harm to any person".

At the time, Minogue labelled the legislation a "defacto death sentence".

A second High Court challenge was filed by Minogue's lawyers in April this year, arguing the law is "cruel and unusual punishment".

They argued the Victorian parliament does not have the power to impose punishment through legislation.
