Queensland's embattled Chief Justice Tim Carmody will be back at work on Monday, but it still remains to be seen how long he will remain in the state judiciary's top spot.

Justice Carmody is scheduled to return from extended sick leave after taking time off for a back problem.

But there was uncertainty over whether he would return to the same job after entering negotiations with the government to resign amid escalating tensions with other judges.

A spokesman for Attorney-General Yvette D'Ath confirmed Justice Carmody would be back at work on Monday, sitting as president of the Queensland Civil and Administrative Tribunal.

The spokesman said it was not uncommon for the chief justice to fulfil this role as part of their duties.

However, he also confirmed conversations between Ms D'Ath and Justice Carmody about the nature of his resignation were ongoing and confidential.

It is understood Ms D'Ath has been negotiating the terms of Justice Carmody's resignation since mid-April.
