Qld CCC must consider 'whistleblower' case

A Queensland civil libertarian is demanding an independent assessment of misconduct charges levelled against a police whistleblower amid concerns it could be a cover up.

Gold Coast police officer Rick Flori is facing a criminal misconduct charge after allegedly leaking CCTV footage of colleagues assaulting a man in handcuffs in January 2012.

But Queensland Council for Civil Liberties vice president Terry O'Gorman plans to ask Police Commissioner Ian Stewart to appoint an independent QC to advise if the prosecution should go ahead at all.

This independent legal mind would then be able to determine if the charges were valid, or should be discontinued, Mr O'Gorman said.

He also plans to write to the Crime and Corruption Commission outlining how Sgt Flori's ongoing prosecution may be putting the state at risk of "returning to the bad old pre-Fitzgerald days".

"The submission to the CCC will deal with the fundamental position that what is publicly revealed - the investigation of the bashing by the police, investigating themselves - appears to have been at best flawed and at worst, a cover up," he told AAP.

He said they could also consider the accusation that Sgt Flori was charged as "payback" for supposedly leaking the security footage against his colleagues.
