Case against gun-toting Qld cop may go

Lawyers for a Queensland police officer accused of pulling his gun on a motorist will apply to have charges against him dismissed, a court has heard.

Stephen Patrick Flanagan, 45, was charged with one count each of common assault and deprivation of liberty after allegedly drawing his firearm on a driver suspected of speeding near Longreach in May 2015.

The matter was initially set down for a two-day hearing next week.

But lawyers for the suspended senior constable told the Brisbane Magistrates Court on Friday they intended to apply for a stay of proceedings to dismiss both charges instead.

It's understood they will claim the case against him shouldn't go ahead on the grounds of an abuse of process.

Magistrate Belinda Merrin delisted the summary trial, replacing it with a hearing for the stay-of-proceedings application on Monday.
