Townsville police officer sues for $2m over nightclub stabbing

A police officer who was stabbed in the neck while on duty is suing the state and a Townsville nightclub for more than $2 million.

Luke Peter Weiks was patrolling the Santa Fe Gold nightclub in December 2013 when a former bouncer attacked him.

The 36-year-old officer claims his injuries were so severe that he continues to suffer pain and restriction of his enjoyment of life.

He is now seeking $936,642 in damages from his employer, the state of Queensland, plus $1,118,155 in damages from nightclub owners Manpel Pty Ltd.

In a statement of claim filed in the Supreme Court, Mr Weiks alleges he was put at unnecessary risk of injury because both police and the nightclub had failed to enforce the Townsville Drink Safe Precinct's procedures.

The claim outlines details of a violent assault by the former bouncer, Andrew Max Wilson, on a patron in early 2013.

Specifically, Mr Wiekes alleges that Wilson should have been banned from the area or brought to his attention.

Mr Weiks' lawyer, David Taylor, said no amount of money could make up for the terrible ordeal.

"His injuries could have been avoided had the procedures in place been followed, which would have ensured he approached the offender with caution, rather than mistaking him as continuing to be an employee of the club," Mr Talyor said.
