Small win for Mehajer siblings in court

Prosecutors in Salim Mehajer's electoral fraud case say they have text messages in which the former Auburn deputy mayor allegedly discusses preparing false enrolment applications with his sister Fatima Mehajer.

The siblings are accused of submitting dozens of false applications to change voters' addresses into the Auburn area ahead of the September 2012 Auburn Council elections.

Both were candidates in the election but only Salim Mehajer was successful.

They are scheduled to face a hearing in the NSW Local Court on June 15 and the prosecution has applied to use about 100 documents, including the 58 text messages, as "tendency evidence".

But in a small win for the Mehajers on Monday, magistrate Beverley Schurr decided that only the text messages were admissible.

Some of the messages, sent on July 30, 2012, allegedly read "What's the address for my members?", "No such address. I'll re-enroll him" and "Make sure they are all in Auburn", the magistrate's written decision states.

The Mehajers are charged with multiple counts of agreeing to use forged documents and agreeing to give false or misleading information to a commonwealth entity.
