Rape accused 'looking forward' to retrial

A Sydney man accused of raping a teenage girl in an alleyway behind his father's Kings Cross nightclub has declared he is "looking forward" to a retrial.

Luke Andrew Lazarus, 24, served 11 months of a three-year minimum jail term after he was convicted in the District Court of attacking an 18-year-old woman behind the Soho club in May 2013.

He was released from Sydney's Long Bay facility in February after successfully challenging that conviction, and on Tuesday the state's highest court ordered a retrial take place.

Lazarus was supported in the NSW Court of Criminal Appeal by friends and family, including his businessman father Andrew Lazarus.

The young man showed no expression as the judgment was handed down, but silently put his arm around his mother Denise as he left the courtroom on Tuesday morning.

"I'm very much looking forward to a retrial, I'm excited to clear my name in the future," Lazarus told reporters moments later, as he made his way to a waiting car outside the law courts complex.

No date has been set for the retrial but it is unlikely to take place for some months.

But the case is due back in the NSW Supreme Court on Wednesday, when his lawyers will seek to have his bail conditions varied.

Currently Lazarus is required to report to Rose Bay police, near his family's home in the exclusive eastern suburb of Vaucluse, three times per week.

Lazarus is also banned from approaching or attempting to contact his alleged victim or anyone she was with on the night.

His current bail conditions do not allow him to own a passport or travel outside Sydney.

His family in February backed his bail bid with an offer of $50,000 security.

The iconic nightclub at the centre of the allegations closed in June 2015, after operating for nearly two decades.

At the time, figures close to the venue blamed the city's controversial pub and bar lock-out laws and late-night alcohol restrictions.
