Former NSW minister Ian Macdonald and ex-union official John Maitland have been ordered by a Sydney court to surrender their passports.

MacDonald is being prosecuted for misconduct in public office over his handling of a lucrative mining licence at Doyles Creek in the Hunter Valley.

Maitland is also alleged to have been involved in the project.

Magistrate Graeme Henson on Thursday placed conditions on the pair's bail, including that they surrender their passports and agree not approach witnesses.

The matter will return on February 24.
