Forensic bid over mum's murder accused

A Sydney man accused of murdering his mother last week is mentally incapable of consenting to a police application for a forensic sample, a magistrate has been told.

Joel Woszatka, 25, is charged with the stabbing murder of Lanell Chris Latta, 50, and assault occasioning actual bodily harm upon her partner, Geoff Robson-Scott, on September 18 in their northern beaches home.

In Central Local Court on Tuesday, Woszatka's lawyer Sophie Coulson, said her client was considered to be "incapable" of giving consent and the police application was set down for hearing on October 27.

She said police had obtained an interim order, meaning they have taken a sample but cannot test it, and are now seeking a final order.

Woszatka did not appear in court, either in person or by video link, and bail was formally refused.

The matter was adjourned to November 28.
