Asylum seeker faces NSW assault trial

An asylum seeker is facing trial in Sydney accused of breaking into a university student's bedroom and molesting her as she slept.

Sri Lankan man Daxchan Selvarajah is charged with aggravated break and enter with indecent assault.

The student woke in the early hours in February 2013 to the feeling of an intruder's cold hand inside her pyjama trousers, Sydney District Court was told on Wednesday.

Chasing him downstairs and out the back door of the building, the victim screamed "who the hell are you? Get the f*** out of my house!"

The Crown alleges Selvarajah broke a rear flyscreen door and forced his way into the Marsfield unit about 3.30am on February 21, 2013.

He allegedly attempted to enter another woman's bedroom first, only to find it locked, then crept into the victim's room and touched her groin area and genitals.

He has also been charged with separate break and enter and intent to commit indecent assault charges.

The Crown said in its opening submissions it would rely on fingerprint evidence to place Selvarajah inside the unit.

"He opened the rear door by breaking into the flyscreen door, put his hand into the window and pulled down the handle of the door," crown prosecutor Peter Thompson said.

"He went into the victim's room and it's alleged he indecently touched her and indecently assaulted her."

Defence lawyer Alissa Moen said her client did not dispute entering the building or the victim's bedroom but did not break the flyscreen door and did not commit indecent assault, nor did he enter with the intent of doing so.

She said Selvarajah, who had been living with a friend close to the victim's accommodation, pleaded not guilty to all three charges.
