Appeal ordered in NSW alleyway rape case

The case of a Sydney man who was acquitted of raping a woman in an alleyway behind a nightclub is headed for the Court of Criminal Appeal.

Luke Andrew Lazarus, 25, has previously spent time in jail over the incident in 2013 but his conviction was overturned and a judge-alone trial was ordered.

Last month, he was acquitted after Judge Robyn Tupman found the complainant's evidence that she said "stop" was unreliable.

NSW Director of Public Prosecutions on Thursday lodged an appeal to the Court of Criminal Appeal.

The then 18-year-old had alleged she was assaulted behind Soho nightclub after meeting Lazarus on the dance floor. His hotelier father Andrew owns the club.

Following the acquittal, the woman took to social media and said she felt mad, heartbroken, let down and confused.
