A man has been charged with murder after an alleged assault victim died in a Sydney hospital this morning.

The 76-year-old man was allegedly assaulted on September 29, when police were called to Liverpool Road in Ashfield.

He was taken to Royal Prince Alfred Hospital in a critical condition, which is where he passed away today.

A 58-year-old man was arrested on October 4 over the alleged assault at a shopping centre in Ashfield.

He was initially charged with reckless grievous bodily harm, and resisting police, but has now had his charges upgraded to murder.

He was refused bail at Burwood Local Court on October 4, and will face the same court on October 23 over the murder charge.
