The federal Environment Department has conceded green groups are allowed to collect tax-deductible donations to pay fines for unlawful acts.

Nationals senator Matthew Canavan claims there are cases where registered organisations whose staff or volunteers have been fined for unlawful acts have made public calls for tax-deductible donations to pay the penalties.

Asked whether such actions were legitimate, the department's deputy secretary Steven Kennedy told a Senate estimates hearing in Canberra on Monday: "It's not expressly prohibited."
