Fair Work rejects Aerocare agreement

The Fair Work Commission has knocked back aviation services firm Aerocare's enterprise agreement over concerns about inadequate pay and overtime arrangements.

Commissioner Nicholas Wilson on Thursday found the agreement failed what's known as the "better off overall test" when it came to areas including weekend and public holiday payments, and split-shifts and overtime arrangements.

The test requires employees under the new agreement be better off overall than under the relevant modern award.

"The group of employees to be covered by the 2017 Agreement was not fairly chosen, due to the exclusion of casual employees," Mr Wilson said in his decision.

Aerocare - which provides services including baggage handling and aircraft cleaning - was earlier this year hit with claims that some staff at Sydney Airport were forced to sleep in makeshift "camps" in baggage handling areas in between shifts.

But Aerocare later said an investigation by the company, the Australian Border Force, and Sydney, Melbourne, Brisbane and Perth found the claims were without foundation.

The ACTU said the Fair Work Commission's decision was a win for workers, claiming the company's proposed enterprise agreement was "dodgy" and fell well short of the award.
