Dutton won't deport Afghani man, for now

An Afghani asylum seeker pleading to stay in Australia won't be deported immediately, despite his visa running out.

Brisbane-based Nadir Sadiqi arrived in Australia in 2010 and claims he was tortured and his father killed by the Taliban.

But his temporary protection visa lapsed on August 6 and now he's scared he'll be deported.

If he is, Sadiqi fears he'll be killed after receiving death threats via social media.

It comes after the private details of 10,000 asylum seekers were leaked by the Immigration Department in an online bungle in February.

The immigration department on Thursday said it is currently reconsidering Mr Sadiqi's case.

"The department will not detain or initiate removal processes whilst this individual has ongoing matters before the department," a spokesperson for Immigration Minister Peter Dutton said.

Australia also wouldn't return rejected asylum seekers back to places that would contravene the country's non-refoulement obligations, they said.

Now, Mr Sadiqi - and almost 65,000 people who signed an online petition to keep him in Australia - must wait for the decision.

"I'm very worried," he told ABC Radio.

"(But) I have a little bit of hope."
